This Global Privacy Policy applies to the CannaMLS website and any associated websites, products, services, mobile applications, or other websites or applications which we currently own, or in the future may own or control, to which this Global Privacy Policy is posted (collectively, the “Services”).

This Global Privacy Policy does not apply to any public areas of the CannaMLS website or services. Any information you provide when interacting with other users, replying to listings, creating profiles, or adding contact information to listings or directories may be publicly visible. In these instances, CannaMLS is not liable for any personal information you choose to share publicly

When you use our Services, you may have the option to engage with features operated independently by third parties, such as social media integrations and links to external websites. Please note that these third parties are outside CannaMLS’s control and we are not responsible for their privacy practices. This Global Privacy Policy does not cover websites or features outside CannaMLS’s ownership or control. We recommend reviewing the privacy policies of any third parties you interact with.

Unauthorized Posting of Personal Information

CannaMLS is not responsible or liable for any instance where another individual or user publishes your Personal Information on our website without your consent. If you discover that your Personal Information has been published on our website without authorization, please contact us immediately to request its removal, and we will take prompt action to address your request.

Children Under 18

Our Services are not designed for children under 18, and we do not intentionally collect Personal Information from users under this age. If you are under 18, please refrain from using the Services, providing any information, registering, or making purchases. If we discover that we have collected Personal Information from a child under 18 without verified parental consent, we will promptly delete it. If you believe we may have any information about a child under 18, please contact us.

1. Types of Personal Information

“Personal Information” refers to any data that directly or indirectly relates to an identified or identifiable individual. This does not include information that is de-identified or aggregated, certain publicly accessible information, or information governed by other legal frameworks.

  • Contact Information – Name, nickname, mailing address, email address, and phone number. Additionally, this may include contact information for individuals you refer to our Services. Typically, we send these individuals a single email inviting them to explore our Services. We retain this information solely for the purpose of sending this one-time email and to monitor the effectiveness of our referral program.
  • Demographics – Gender, language preference. This may include information that we collect to enhance our business contact records, such as gender and language preferences.
  • Business and employment information – Business contact information, department, job title/description, professional license numbers. This may also include your listing information and professional performance within the context of certain Services.
  • Login Credentials – Username and password, if you chose to create an account with us.
  • Audio and visual information, including usage details – Log-in activity and browsing details, such as search history, saved searches, and listings viewed. This can also include records of users, advertisers, or partners you contact and messages you send to them. Additionally, this may include audio or video recordings of customer service interactions or calls you make to inquire about specific listings or our Services.
  • Technical details – IP address, geolocation information, information about your browser and operating system, unique device or hardware IDs.
  • Payment and financial information – This includes your payment details and other payment or financial information. For example, this may include information that you provide in a Help Request or Financing Request, such as budget or prior revenue.
  • Commercial information – This includes previous listings, goods, or services you have purchased, leased, or expressed interest in, whether through our Services or in other settings. We may gather this information via third parties, including tracking tools from data analytics providers and advertising or marketing networks.

We may also gather any other information you choose to provide through the Services. This information, along with the other data mentioned above, may be used to infer insights about your preferences, characteristics, or behavior.

Geolocation Information

Certain CannaMLS products may request or require your opt-in consent for collecting geolocation information during login. We use geolocation data to deliver relevant services you request, like local listing searches with maps or directions. You can disable location-based features by turning off location services on your device or browser.

2. Collection of Personal Information

CannaMLS may gather Personal Information through the following methods:

  • Directly from you when you submit it through our Services or provide it to others via these platforms. This includes data entered into forms or chatbots, as well as information shared through phone calls, messages, subscription agreements, contracts, or other submitted content.
  • Through your engagement in conferences, research studies, focus groups, surveys, promotions, or contests, whether organized by us, our vendors, or business partners.
  • From references or public sources that you provide or that are accessible online or in other formats, such as brochures, listings, public records, or industry groups.
  • From third-party vendors, including data analytics firms and email marketing service providers.
  • By reviewing public websites where allowed by the site’s Terms of Use, such as company websites, search engines, news sites, and social media.
  • Automatically via tracking technologies (like cookies, web beacons, or log files), including across third-party websites and other online services over time.

We may use automated processes to suggest listings that align with your interests based on your activity within our Services. By analyzing the listings you view, searches you perform, and your location, we can profile your preferences and highlight options that best match your needs.

4. Disclosure of Personal Information

We may share Personal Information as follows:

  • With CannaMLS Affiliates – Including affiliated companies, business partners, distributors, and service providers within CannaMLS’s network.
  • With Other CannaMLS Users – For instance, with listing authors when you visit their listing, with PROs when you visit their profile, show interest in a listing, or submit inquiries. We may also share information with other subscribers in directories or inventories provided within our Services that you participate in.
  • In Public Features – Information shared through content-sharing or messaging features, community forums, or public pages on our Services may be visible to other CannaMLS users. Please avoid posting information you don’t wish to make public.
  • With Third Parties for Referrals – If you choose to share content, like using our “Email a Listing to a Friend” feature, or similar tools, we may share relevant information with the designated third party.
  • When Using Third-Party Features – Such as social media networks, when sharing content to those networks or logging into our Services with a social media account.
  • For Legal and Contractual Compliance – Including to enforce Terms of Use, comply with legal requirements, or respond to government or regulatory inquiries.
  • In Business Transactions – Personal Information may be disclosed to a buyer or successor as part of a merger, sale, restructuring, or other transfer of CannaMLS assets.
  • With Professional Advisors – Such as consultants, auditors, or legal professionals assessing CannaMLS’s business or compliance obligations.
  • To Protect Safety and Rights – If necessary to protect CannaMLS’s rights, property, or safety, or that of others.
  • For Stated Purposes – Any purpose we disclose at the time you provide the information, or with your explicit consent.

Third-Party Business Support

We may also share your Personal Information with third-party vendors who support our business functions, such as data analysis, email marketing, payment processing, customer relationship management, and IT infrastructure.

5. International Transfer of Personal Information

CannaMLS operates globally. We may transfer your Personal Information to the United States, where our headquarters are located, as well as to other countries that may not have the same privacy laws as the country where you originally provided the information. However, we will safeguard your Personal Information in line with this Global Privacy Policy or as otherwise communicated to you.

6. Security of Personal Information

CannaMLS employs various security measures to protect your Personal Information.

We utilize administrative, technical, and physical safeguards designed to prevent the accidental, unlawful, or unauthorized destruction, loss, alteration, access, disclosure, or misuse of Personal Information. For instance, payment card data is encrypted following the Payment Card Industry Data Security Standard (PCI DSS), and sensitive data, such as geolocation information, is stored on servers in the United States with access restricted to authorized personnel.

While we work diligently to secure data, we cannot guarantee the security of information transmitted online. If you have a password for your account, it is your responsibility to keep it confidential. If you have any security-related questions, you may contact us at support@cannamls.com.

7. Retention of Personal Information

CannaMLS will keep your information only as long as reasonably necessary for the purposes outlined in this Global Privacy Policy, for as long as your account remains active (i.e., throughout the lifetime of your CannaMLS customer account), or as needed to provide Services to you. If you no longer wish for CannaMLS to use your information to deliver Services, you may close your account. CannaMLS will retain and use your information as necessary to meet legal requirements, resolve disputes, enforce agreements, and as otherwise detailed in this Global Privacy Policy. Please note that closing an account may not free up your email address, username, or listing name (if applicable) for reuse on a new account. We also retain log files for internal analysis, typically for a limited time, unless needed to ensure the safety and security of the Services, support functionality improvements, or fulfill legal obligations.

8. Manage Your Personal Information

You have options to manage your Personal Information. If any of the Personal Information you provided to us is outdated or incorrect, you can review and update it within your online account by logging in, or you may Contact Us. Depending on your location, you may also have additional rights as described below. For security, we may request information to verify your identity before processing requests related to your Personal Information. By using the Services, you agree to receive direct mail, email newsletters, promotional emails, and promotional phone communications.

Opting Out of Direct Marketing

If you no longer wish to receive CannaMLS’s direct marketing emails, you may click the “Unsubscribe” link within any email to stop receiving communications on that topic. Depending on the Services, you may also manage your notification preferences in your account. Note that CannaMLS may still contact you regarding the Terms of Use, Global Privacy Policy, or other legal notices, or in connection with Services you have requested.

Opting Out of Tracking/Online Advertising

You can disable or delete browser cookies in your browser settings. While disabling cookies is straightforward, the process differs between browsers. Please note that some parts of our website may not function properly if you disable or delete cookies or use third-party software to manage cookies.

You can also opt out of third-party data collection for targeted advertising in the United States or Canada via the National Advertising Initiative (NAI) and Digital Advertising Alliance (DAA) opt-out pages, and in the European Economic Area (EEA) via the Programme’s opt-out page.

Please note that our Services do not currently recognize “Do Not Track” signals.

Exercising Your Rights

To make a request, please Contact Us by email or submit your request through your CannaMLS support page. CannaMLS may ask for additional information to verify your identity before processing your request.

For requests related to deletion, restriction of processing, withdrawal of consent, or objection to processing, further collection of your data will cease upon request verification.

Only you, or an individual legally authorized to act on your behalf, may make a verifiable request regarding your Personal Information. Authorized agents may Contact Us by email with proof of your signed permission to make such requests. CannaMLS may also require you to verify your identity and confirm your authorization.

9. Jurisdiction Specific Notices

We collect the types of Personal Information outlined in Section 1 (“Types of Personal Information”), which correspond to the following categories under the California Consumer Privacy Act:

  • Identifiers
  • Categories of Personal Information as defined by California Civil Code § 1798.80(e)
  • Characteristics of protected classifications under state or federal law
  • Commercial Information
  • Audio and Visual Data
  • Internet or other electronic network activity
  • Geolocation Data
  • Professional or employment-related information
  • Inferences based on other Personal Information (such as profiles reflecting your preferences, characteristics, and behaviors)
  • Sensitive Personal Information, including precise geolocation, login credentials (username and password), and message content sent through the Services.

As further detailed in Section 2 (“Collection of Personal Information”), CannaMLS gathers Personal Information from the following sources:

  • Directly and indirectly from you
  • Other CannaMLS customers
  • Service providers, including data analytics firms
  • Third parties, such as advertising services and social media platforms
  • Publicly accessible company websites
  • Government entities

CannaMLS shares the following categories of Personal Information, as specified in Section 3 (“Use of Personal Information”) and Section 4 (“Disclosure of Personal Information”), with the categories of third parties listed, within the 12 months prior to the last modification date of this Global Privacy Policy.

  • Identifiers – Third Parties: Service providers, data analytics and advertising vendors, brokerages (and other parties participating in transactions related to your use of the Services), operating systems and platforms, social media networks, other CannaMLS users or subscribers.
  • Categories of Personal Information as defined by California Civil Code § 1798.80(e) – Third Parties: Service providers, other CannaMLS users or subscribers, and data analytics and advertising providers.
  • Commercial information – Third Parties: Affiliates, distribution partners, other CannaMLS users or subscribers, data analytics and advertising providers.
  • Internet or other electronic network activity information – Third Parties: Service providers, other CannaMLS users or subscribers, and data analytics and advertising providers.
  • Geolocation data – Third Parties: Service providers, other CannaMLS users or subscribers, and data analytics and advertising providers.
  • Professional or employment-related information – Third Parties: Service providers, other CannaMLS users or subscribers.
  • Inferences – Third Parties: Service providers, including data analytics and advertising providers.
  • Sensitive Personal Information, including precise geolocation, login credentials, and the contents of messages sent through the Services – Third Parties: Service providers

CannaMLS may also “sell” or “share” certain categories of Personal Information. Within the 12 months prior to the last modification of this Global Privacy Policy, CannaMLS has sold or shared:

  • Identifiers (such as IP address and other online identifiers), categories of Personal Information as defined in California Civil Code § 1798.80(e), geolocation data, Internet or other electronic network activity information, and commercial information (like purchasing behaviors or records of services purchased or considered) to advertising providers for the purpose of promoting our Services. We may also “sell” these categories to other CannaMLS customers or subscribers so they can reach out to you about listings or services of interest.
  • For CannaMLS Products: Identifiers (e.g., name, email address), categories of Personal Information per California Civil Code § 1798.80(e) (e.g., phone number), and professional information (such as name, title, email address, and business address) may be shared with other CannaMLS customers or subscribers to provide business contact information in the PRO Directory or similar features within CannaMLS Products.

California Resident Rights

If you are a California resident, you have the right to: (1) request that CannaMLS disclose the Personal Information we collect, use, disclose, and sell; (2) request deletion of Personal Information, subject to certain exceptions; (3) request corrections to inaccurate or incomplete Personal Information; (4) opt-out of the sale of Personal Information; (5) opt-out of “sharing” Personal Information for cross-context behavioral advertising, and (6) be free from discriminatory treatment by CannaMLS for exercising these rights.

Requests to Know

You may request that we provide information on:

  • Specific pieces of Personal Information CannaMLS has collected about you;
  • Categories of Personal Information CannaMLS has collected, disclosed, or sold;
  • Categories of sources from which Personal Information was collected;
  • Categories of third parties with whom CannaMLS shares or sells Personal Information; and
  • The business or commercial purpose for collecting, selling, or sharing Personal Information.

Opt-Out of the Sale or Sharing of Personal Information

You may opt-out of the sale of your Personal Information by contacting us via email or visiting our Do Not Sell My Personal Information page. To opt-out of CannaMLS’s sharing of your Personal Information for advertising purposes, you can additionally manage your Tracking/Online Advertising privacy controls.

We do not knowingly sell or share Personal Information of individuals under the age of 18.

We do not use or disclose sensitive Personal Information for purposes other than those specified in California Civil Code § 1798.121.

9.2 Additional Notice to Certain Other U.S. Residents

If you reside in certain U.S. states—including Nevada, Virginia, Colorado, Connecticut, Utah, and Iowa—you may be entitled to specific privacy rights based on verifiable residency. CannaMLS reserves the right to validate your residency before processing any requests to exercise these rights. You may have the right to request the following: (1) that CannaMLS disclose and provide a copy of the Personal Information we collect, use, disclose, and sell; (2) that CannaMLS delete your Personal Information, with certain exceptions; (3) that CannaMLS correct inaccurate or incomplete Personal Information; (4) opt out of the sale of Personal Information; (5) opt out of targeted advertising; (6) opt out of profiling that leads to decisions with legal or similarly significant effects, and (7) to not receive discriminatory treatment from CannaMLS for exercising these rights.

9.3 Additional Notice to European Economic Area (EEA) and United Kingdom Residents

If we are required by law or by the terms of a contract with you to collect Personal Information and you do not provide it when requested, we may not be able to fulfill the contract we have or are attempting to enter into with you. In such cases, we may need to cancel a product or service you have with us, but we will inform you beforehand.

Consent

In certain situations, we may seek your consent to process your Personal Information, such as when sending you relevant marketing information, when you request information from us, or when you reach out to express interest in our Services. Data Transfers for EEA and United Kingdom Residents

9.4 Additional Notice to Canada Residents

We may use service providers outside of Canada, including, but not limited to, the United States, to process Personal Information and may transfer your Personal Information to these providers for that purpose. When your Personal Information is processed outside Canada, it will be subject to the laws of the countries where it is processed and may be accessible to law enforcement and national security authorities in those countries, as required by their laws.

If you reside in Canada, in addition to other rights outlined here, you may have the right to: (1) request access to, review, and correct inaccuracies or omissions in your Personal Information; (2) withdraw consent for the collection, use, or disclosure of your Personal Information, or request its deletion (please note that this may limit our ability to provide services dependent on that information); (3) ask questions about our policies and practices, or lodge complaints regarding our compliance, either with us or with regulatory authorities; and (4) if you reside in Quebec, request an electronic copy of your Personal Information in a structured and commonly used format.

This Global Global Privacy Policy may be updated periodically to reflect changes in our privacy practices.

We will post any updates on this page and indicate the date of the last revision on the page. If we make significant changes to our privacy practices, we will notify you with a notice on the homepage of the websites covered by this Global Privacy Notice. If a material change affects Personal Information we have already collected—such as new purposes for which the information will be used or disclosed that were not previously consented to—we will also seek your affirmative consent.
